About custody disputes

When parents cannot agree

A separation often raises difficult questions about the children. If the parents cannot agree on custody, residence or contact, the district court can decide the matter. The best interests of the child are always decisive.

A legal representative can help you understand the process, present what is relevant for the child and, where possible, work towards a lasting agreement.

Common questions

Questions and answers

Does a custody dispute have to be decided in court?+

No. As parents, you can reach an agreement through co-operation talks with family services or enter into an agreement approved by the family law unit. The court considers the matter if you cannot agree.

How long does a custody dispute take?+

It varies. Proceedings involving a custody assessment can take from a few months to more than a year. Interim decisions, which apply temporarily, can be made earlier.

Can your child express their wishes?+

Your child's wishes must be taken into account in light of their age and maturity. Your child does not have to take a position, and their views are usually obtained by social services.

Can you use the legal expenses cover in your home insurance?+

Often, yes. The terms vary between insurers. We can help you with the application once you have instructed us.
